INTRODUCTION

 

The company EUROPE DRIVE whose head office is domiciled at, 8 Rue De L'église Ablon-Sur-Seine 94480, Unipersonal Limited Liability Company with capital of €3000, registered under number R.C.S 842 580 425 of Créteil, and operating under number EVTC094181207 of the Register of VTC Operators of  Ministry of Ecological Transition and Territorial Cohesion.

Transporting people for a fee is a regulated activity and authorized only vehicles allowed to this service.

ARTICLE 1

 

The customer declares to have read and to have accepted the general conditions of sale previously once his order is sent. Validation of the order by EUROPE DRIVE implies acceptance of the general conditions of sale by the customer.

ARTICLE 2 – RESERVATIONS

 

All services must be the subject of a reservation confirmed by the company.
Reservations can be made on our page dedicated to this purposehttps://www.europedrivetours.com/reservation, by phone at +33781915515 or directly by email at reservation@europedrivetours.com.
An email confirming our availability will then be sent by our services.

All service reservations must be made no later than 24 hours before the start of the desired service.
It must be carried out by the customer or by a duly authorized representative.

Any reservation must imperatively mention the following elements: name and contact details of the customer (address, email, telephone), address of the pick-up location and address of the place of arrival for transfers, the desired duration for hourly disposal, date and starting time of the service, number of passengers and number of luggage.

ARTICLE 3 – SERVICE

The service begins at the place of parking of the vehicle, on the day and time fixed in the contract previously established between the parties.
It ends on the day and at the time of return of the vehicle to its place of departure.

In case of a delay by the customer, the driver will wait 15 minutes at the pick-up location. After this period, the company EUROPE DRIVE will consider the service cancelled. This will be charged to the customer and will not give rise to any refund.

If it turns out that the customer is not present at the meeting place, the service would be definitively lost, due by the customer and would not give any right to reimbursement.

If the customer cannot find the driver, he must immediately call EUROPE DRIVE to avoid being charged the full amount of the service.

Respect and proper use of equipment is essential. Any deterioration of the material and any damage caused to the interior of the vehicle will be the responsibility of the customer and will be invoiced to him. And it is strictly forbidden to smoke inside the vehicle.

Wearing a seat belt is obligatory in the front and rear of the vehicle.

Animals are not allowed in vehicles, except in a cage or bag provided for this purpose.

EUROPE DRIVE is in no way responsible for items forgotten in vehicles or elsewhere during the service.

Under no circumstances may the customer require the driver to exceed the authorized speed limit or commit any traffic violations.

More generally, the driver reserves the right to refuse any instructions and/or requests from the customer that he considers to be likely to compromise the safety of the occupants of the vehicle and other road users.

Our drivers are professionals, their responsibility is engaged, they are instructed to respect and enforce the laws in force.

EUROPE DRIVE reserves the right to interrupt any service on the spot, in case the customer should behave in a way that compromise the safety of the driver, the rented vehicle or other road users. The service will then be invoiced in full to the customer. Customers who are too drunk or insulting the driver will not be able to board the vehicles under any circumstances. The service will then be invoiced in full to the customer.

 

The volume of luggage transported is proportional to the capacity of the vehicle. They remain throughout the service under the responsibility of the persons transported.

Any modification of the journey by the customer or by his instructing party may result in supplements which will be invoiced to him.

The service provided by the company EUROPE DRIVE as regulated by articles L.231-1 to L.231-4 and R.231-1 to R.231-9 of the Tourism Code, consists on providing a vehicle to the customer, inseparably accompanied by the services of a driver.
Are thus included in the service:

• the vehicle made available to the customer;

• the provision of a driver speaking at least French;

• professional insurance for passengers transported for a fee, kilometers travelled, vehicle maintenance, fuel and the duration determined when booking the service

• the transport of the customer's luggage, within the limits of the possibilities of the vehicle.

• the cost of tolls

Are not included in the Service:

• the cost of car parks and more generally of all parking places;

• entrance fees to sites (museums, theatres, castles, stadiums or others);

• entrance fees to public places

• the meal and accommodation costs of the driver for a trip over several days.

ARTICLE 4 – PRICE

 

The prices indicated on our site are for information only and can be modified according to the desired times. To confirm this rate, it is recommended to send a reservation request. EUROPE-DRIVE will confirm all the details of this request and in particular the price of the service.

Our prices include VAT, and are expressed in Euros (€).
The applicable VAT rate for transfers is 10%.
The applicable VAT rate for hourly deliveries is 20%.

The transfer rate applies to direct travel, without stopping, without stages, from the place of pick-up to the place of arrival previously established in the contract.

Prices are per vehicle, regardless of the number of people transported (up to 3 or 4 for sedans and up to 7 for minivans).

For the provision, any hour started is due.
Any additional kilometer to the package established by the contract will be charged:

€2.60 incl. VAT/km for E-Class, €3.20 incl. VAT/km for V-Class, €4.20 incl. VAT/km for S-Class.
Any additional hour to the fixed rate established by the contract will be invoiced:

80€/hour for Class E, 90€/hour for Class V, 130€/hour for Class S.

For trips planned over several days, the following flat rates will be invoiced to the customer:

• meal = 20€ including tax

• hotel night + breakfast = €100 including tax

ARTICLE 5 – REGULATION - PAYMENT

​

The payment of the price is made when ordering, no order can be confirmed in the absence of full payment.

We accept payment by bank transfer, in cash and by credit cards (Visa, Mastercard, American Express, etc.),

or by STRIPE or SumUp secured payment link.

In all cases, the customer signing the reservation is responsible for the payment of the service in case of default by the user.

​

For wedding or excursion packages, the reservation only becomes firm after payment of a non-refundable deposit equal to 30% of the amount of the service.

 

ARTICLE 6 – CANCELLATION

 

• Any reservation canceled less than 24 hours before the start of the service will be charged to the customer at 100%.

• Any reservation canceled  between 72 hours and 25 hours before the start of the service will be charged to the customer at 50%.

• Cancellation is free of charge only 72 hours before the start of the service.

 

ARTICLE 7 – LIMITS OF RESPONSIBILITIES

 

EUROPE-DRIVE can in no way be held responsible for delays in rail and air traffic.

EUROPE-DRIVE can in no way be held responsible for delays due to road traffic beyond its control: road blocked, bridge closed to traffic, traffic jams, flooded road, demonstration, weather conditions, interventions by the police, firefighters or customs, etc… 

EUROPE-DRIVE can in no way be held responsible for delays directly resulting from an initial delay by the customer, or the need to make a trip, at the request of the customer, within a time that is clearly too short.

In the event of immobilization of the vehicle due to a mechanical failure, an accident or damage (theft, degradation),EUROPE-DRIVE will endeavor to ensure the continuity of the route, either with one of these vehicles, or with a vehicle chartered from another company and undertakes to notify the principal.

 

ARTICLE 8 – INSURANCE

 

The responsibility of EUROPE-DRIVE is limited to the terms of our insurance contract.

Our vehicles are insured for the transport of people and our travelers for all bodily injury with our insurer. This insurance also covers professional civil liability, in accordance with the French regulations in force, pursuant to article L. 3120-4 of the Transport Code.

The instructing party shall have every right to take out additional insurance at his own expense covering cancellation costs, repatriation costs or luggage transported.

 

ARTICLE 9 – PERSONAL DATA

 

EUROPE-DRIVE is committed to respecting the privacy of its customers.

EUROPE DRIVE undertakes to respect the confidentiality of the personal data collected on its website in accordance with the French Data Protection Act n°78-17 of January 6, 1978. As such,EUROPE-DRIVE undertakes not to disclose to third parties the information communicated by the customer on his website and to use it only for the processing of his reservation.
The customer can exercise a right of access to his file and a right of rectification or deletion of information concerning him by sending his request to Customer Service of EUROPE-DRIVE.

 

ARTICLE 10 – DISPUTES

 

Any complaint must be notified in writing and by registered letter to the attention of Customer Service, within a maximum period of 8 days. After this period, no complaint will be successful.

Subject to legal provisions, any dispute is, by express agreement, the exclusive jurisdiction of the Commercial Court of Paris.
